Georgia Man Accused of Fatally Shooting Restaurant Customer After Claiming He Was Having an Affair With His Wife

A late-night outing at a restaurant in Georgia turned deadly after a man allegedly opened fire on another customer he believed was having an affair with his wife. The shooting killed a 44-year-old man and left two other people injured by flying glass, according to police.

Daniel Roman-Cortez, 44, has been charged with murder and six counts of aggravated assault with a weapon in connection with the October 25, 2026, shooting in Doraville, just outside Atlanta. The victim was identified as Pablo Gutierrez-Gallegos, also 44, according to authorities and court records cited by Law&Crime.

Police said officers responded shortly after midnight to reports of gunfire near a restaurant along Buford Highway. When they arrived, they reportedly saw Roman-Cortez attempting to leave the area in a blue pickup truck. Officers stopped the vehicle and took him into custody.

According to police, Roman-Cortez allegedly admitted his involvement in the shooting, telling officers, “I shot him. I killed him.” Investigators said he later claimed that he believed Gutierrez-Gallegos was “sleeping with his wife.” Authorities have described the incident as stemming from a personal dispute, though the alleged affair has not been independently established.

Officers found Gutierrez-Gallegos unresponsive outside the restaurant with gunshot wounds. Emergency personnel attempted lifesaving measures, but he was pronounced dead at the scene. Two other customers inside the restaurant were struck by glass fragments caused by the gunfire. Both received medical attention and were later released, police said.

The shooting has left Gutierrez-Gallegos’ relatives grieving a sudden and devastating loss. In a fundraising appeal shared by his sister, the family described him as a friendly man who minded his own business and said his death had left an irreplaceable void in their lives. The family is originally from Mexico, according to the appeal.

Doraville Police Chief Deyette said the department was committed to conducting a thorough investigation and pursuing justice for the victim and his family. Investigators are continuing to examine the circumstances surrounding the shooting, including the events that led to the confrontation outside the restaurant.

Roman-Cortez remains in the DeKalb County Jail without bond, according to Law&Crime. His next court date had not been listed in the report published October 26. The charges against him remain allegations, and he is presumed innocent unless proven guilty in court.
