Child Goes to Visit a Friend and Is Fatally Shot by AR-Style Rifle While 18-Year-Old Eats in Kitchen, Police Say
A casual afternoon spent visiting friends turned into a devastating tragedy when a young boy was fatally shot inside a home in West Virginia. The child had reportedly gone to spend time with friends when a recently purchased AR-style rifle discharged, striking him in the head. What makes the case particularly disturbing is that several children had reportedly been handling and taking pictures with the firearm shortly before the shooting.

The incident happened on November 3, 2026, at a residence on Third Street in Oak Hill, West Virginia. Police officers were dispatched shortly after 2:40 p.m. following a report of a child suffering from a gunshot wound. When officers arrived, they encountered 18-year-old Gabriel Osorio, who appeared extremely distressed and was screaming for help. Near the front doorway, they found a young boy lying on his back with blood on his head. Officers immediately attempted to provide medical assistance while emergency responders were called to the scene.
The child was transported by ambulance to Plateau Medical Center before being flown to Charleston Area Medical Center for further treatment. Despite the efforts of medical personnel, he later died from his injuries. Investigators discovered an AR-style rifle lying on a bed inside the home. The victim’s identity has not been publicly released, but school officials confirmed that he was a student in the Fayette County school district. The school community expressed its grief and said counseling services were being made available to students and staff affected by the loss.
According to the criminal complaint, Osorio told investigators that he had invited three minors to his home while his stepmother was away at the bank. The group gathered in his bedroom to listen to music and spend time together. Osorio allegedly said that one of the children discovered an AR-15-style rifle underneath his bed. He had reportedly purchased the weapon just days earlier. The children then began taking photographs with the firearm, which Osorio claimed initially had no magazine inserted.
The magazine, which reportedly contained approximately six rounds of 5.56mm ammunition, was stored inside a separate locked box. According to Osorio’s account to police, one of the minors found a key left on his dresser, unlocked the box and removed the magazine. Osorio said he took the rifle away and warned the children not to handle it. However, he allegedly told investigators that the same minor later picked up the firearm again. While Osorio was eating in the kitchen, a single gunshot suddenly rang out. He went into the bedroom and found the child wounded. According to the complaint, another minor threw the rifle onto the bed and attempted to leave. Osorio said he stopped that person before returning to help the injured boy and contacting emergency services.
Osorio was subsequently arrested and charged with felony child neglect resulting in death. He is being held at Southern Regional Jail without bond. Authorities have not announced criminal charges against any of the other minors, and the shooting remains under investigation. The case raises serious questions about how a recently purchased rifle and its ammunition were accessible to children inside the home. For the victim’s family, however, the most devastating reality is that a child who simply went to visit friends never made it home. An ordinary afternoon of music and photographs ended with a family mourning an unimaginable loss.
